QubiMap Subscription Agreement

This Subscription Agreement (hereinafter referred to as the “Agreement”) help define the relationship between you and QubiMap H.K Limited (hereinafter referred to as “QubiMap,” “we,” or “our”), regarding your use of the QubiMap Subscription Services (hereinafter referred to as the “Subscription Services”). This Agreement constitutes a supplementary agreement to the QubiMap Terms of Service and forms an integral part thereof. Unless otherwise provided herein, the terms in this Agreement shall have the same meanings as defined in the QubiMap Terms of Service.

Important Notice: Please read all the provisions of this Agreement carefully, especially those highlighted in bold or otherwise reasonably brought to your attention. By confirming your acceptance of this Agreement or commencing use of the Subscription Services, you agree to be bound by this Agreement. If you do not agree, please refrain from purchasing or using the Subscription Services.

1. Description of the Subscription Services

1.1 Subscription Plans: QubiMap offers different levels of service plans. The specific types and corresponding benefits shall be subject to the latest description provided on the subscription page within the application or the Pricing Page of the official website.

1.2 Subscription Benefits: After you subscribe to a service plan, you may enjoy the corresponding exclusive benefits during the validity period. The specific benefits shall be subject to the real-time description provided in the “Free vs. VIP Feature Comparison” section of the official QubiMap Pricing Page, which constitutes an integral part of this Agreement.

1.3 Scope of Services: The Subscription Services are limited to your personal use for non-commercial purposes. Unless expressly authorized by us, you may not transfer, lease, or use service benefits for any commercial activities.

2. Subscriber Account Activation, Management, and Termination

2.1 Activation Method: You may activate the Subscription Services through payment of the plan fee via channels recognized by QubiMap. Upon completion of payment and all necessary procedures, your account will be granted the corresponding subscription benefits.

2.2 Account Security: You shall properly safeguard your account and password. Any losses arising from your own actions (such as account disclosure, loss, or unauthorized use) shall be borne solely by you, unless it can be proven that such losses were caused by QubiMap’s statutory fault.

2.3 Usage Restrictions: Each subscriber account is limited to use by one natural person and may not be logged in by multiple users simultaneously. You may log in on up to five personal fixed devices (such as mobile phones, tablets, or computers). The specific number of permitted devices shall be subject to the subscription benefit description. Replacement of devices or deauthorization of old devices shall be subject to our rules and may incur additional fees.

2.4 Account Termination: You may apply for account termination on the Account Security Page of the QubiMap official website. Upon termination, you will lose all subscription benefits, and any service fees already paid will not be refunded (except as otherwise required by law).

3. Service Term, Fee Adjustment, and Refund

3.1 Service Term: The validity period of the Subscription Services shall commence from the date of successful activation. The specific duration shall be subject to the service plan you select, for example: monthly (30 days from the activation date) or annually (365 days from the activation date). The term shall not be extended due to your non-use of the services.

3.2 Fee Adjustment: We reserve the right to adjust the prices of the Subscription Services. Price changes will be notified to you in advance through in-app notifications or email. Price adjustments shall not affect the Subscription Services that you have already purchased and that remain valid.

3.3 Refund Policy: All service fees, once paid, are non-refundable in principle, except where you are completely unable to access the services due to technical reasons attributable to QubiMap.

4. Code of Conduct and Liability

4.1 Lawful Use: When using the Subscription Services, you shall comply with all applicable laws and regulations and shall not use subscription benefits to engage in any infringing, unlawful, or network security–compromising activities.

4.2 Service Interruption: We may temporarily suspend the Subscription Services due to system maintenance, upgrades, or force majeure. We will make reasonable efforts to provide prior notice; however, to the extent permitted by law, we shall not be liable for any losses incurred as a result.

4.3 Limitation of Liability: In no event shall QubiMap’s total liability to you exceed the amount of fees you have paid to us for use of the Subscription Services during the six months preceding the claim (if any).

5. Governing Law and Dispute Resolution

5.1 Governing Law: The formation, validity, interpretation, performance, and dispute resolution of this Agreement shall be governed by the laws of Hong Kong.

5.2 Dispute Resolution: Any dispute arising out of or in connection with this Agreement shall first be resolved through amicable negotiations between the parties. If negotiations fail, either party shall have the right to submit the dispute to the competent courts of Hong Kong, which shall have exclusive jurisdiction over such disputes.

6. Amendments to This Agreement

We reserve the right to amend this Agreement at any time. For material changes, we will provide you with prominent notice within the application or by email, or through other appropriate means. Your continued use of the Subscription Services after the amended Agreements take effect constitutes your acceptance of the amended Agreements.
